Abstract
The Indian Constitution prohibits discrimination based on sex and supports gender equality in its Preamble, Fundamental Rights, Fundamental Duties, and Directive Principles. Traditionally, the strict understanding of gender as just male or female limited transgender individuals from fully exercising their constitutional rights. Transgender people struggle with basic social rights and holistic health (mental and physical) challenges. According to Article 14 of the Indian Constitution, everyone has the right to equal protection under the law and the state cannot deny anyone this right wherever in India. The rule of law, as outlined in our constitution, is embodied in this article. Article 15 of the Indian Constitution strongly prohibits discrimination or infringement of equal rights based on race, caste, religion, class, or sex. Discussing sexuality is quite important in India. One component of sexuality considered unnatural poses considerable issues for persons who identify as transsexual. They deal with numerous issues in their daily lives. They have to deal with prejudice in all facets of their lives. The absence of employment, educational, and health resources puts the transgender community at danger. Another significant problem is social stigma. The shelter options for transgender people in India are the main topic of this essay.
